Terms of Use (End-User License Agreement)

1. Acknowledgment

This End-User License Agreement ("EULA") is a legal agreement between you ("End-User") and CheckEt Team ("Developer", "we", "us", or "our") for the CheckEt Domains application ("Licensed Application"). You and Developer acknowledge that this EULA is concluded between you and Developer only, and not with Apple Inc. ("Apple"). Developer, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA incorporates by reference the Usage Rules set forth in the Apple Media Services Terms and Conditions.

2. Scope of License

Developer grants to you a revocable, non-exclusive, non-transferable, limited license to install and use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. This license does not allow you to use the Licensed Application on any Apple Device that you do not own or control, and you may not distribute or make the Licensed Application available over a network where it could be used by multiple devices at the same time.

3. Maintenance and Support

Developer is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA, or as required under applicable law. You and Developer acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

4. Warranty

Developer is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Developer’s sole responsibility.

5. Product Claims

You and Developer acknowledge that Developer, not Apple, is responsible for addressing any claims of you or any third party relating to the Licensed Application or your possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

6. Intellectual Property Rights

You and Developer acknowledge that, in the event of any third-party claim that the Licensed Application or your possession and use of that Licensed Application infringes that third party’s intellectual property rights, Developer, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

7. Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

8. Third-Party Terms of Agreement

You must comply with applicable third-party terms of agreement when using the Licensed Application (e.g., your wireless data service agreement).

9. Third-Party Beneficiary

You and Developer acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

10. Platform-Specific Provisions

🍎 Apple App Store Users

If you downloaded the Licensed Application from the Apple App Store, the following additional terms apply:

  • Third-Party Beneficiary: You and Developer acknowledge and agree that Apple Inc., and Apple's subsidiaries, are third-party beneficiaries of this EULA. Upon your acceptance of this Agreement, Apple will have the right to enforce this EULA against you as a third-party beneficiary.
  • License Scope: The license granted herein is limited to use on Apple-branded products that you own or control, as further defined by Apple's Usage Rules.

🤖 Google Play Users

If you downloaded the Licensed Application from Google Play, the following additional terms apply:

  • Google Play Developer Policies: Your use of the Licensed Application is also subject to the Google Play Developer Content Policy and the Developer Distribution Agreement.

11. One-Time Premium Purchase (Lifetime Access)

Billing & Payment

  • The Licensed Application offers a single, one-time in-app purchase that grants lifetime access to premium features.
  • Payment will be charged once to your Distribution Platform account (Apple ID or Google Play account) at confirmation of purchase.
  • There are no recurring fees, no auto-renewing subscriptions, and no hidden monthly or annual charges.

Restoring Purchases

  • Your lifetime access is tied to your Apple ID or Google Play account. You can restore your purchase on new devices using the "Restore Purchase" option in the app settings, provided you are logged in with the same platform account.

Refunds

  • iOS (App Store): Refunds are handled exclusively by Apple. You may request a refund through Apple's Report a Problem page.
  • Android (Google Play): Refunds are subject to the Google Play Refund Policy. You may request a refund directly via the Google Play Store.

12. Accounts and Authentication

To access certain features of the Licensed Application, you may be required to sign in using third-party authentication services (e.g., Apple Auth, Google Auth). You are responsible for maintaining the confidentiality of your account information. Guest users ("Anonymous Login") are subject to the same terms and may lose their local data if they do not link an account.

14. Privacy

Your use of the Licensed Application is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data (including data processed via Admob, Firebase, and our PostgreSQL backend). By using the Licensed Application, you consent to our data practices as described in the Privacy Policy.
